Terms of Service

House of Avatars

Effective Date: January 18, 2025

---

1. Acceptance of Terms

By accessing and using House of Avatars ("the App"), you agree to these Terms of Service ("ToS"). If you do not agree, you must not use the App. We reserve the right to update these terms at any time. Continued use of the App after changes are posted constitutes acceptance of the revised terms.

2. Who Can Use House of Avatars?

- The App is intended for users 13 years of age or older. If you are under 13, you are not permitted to use the App.

- By using the App, you confirm that you comply with all applicable laws and regulations in your region.

- Accounts are personal and non-transferable. You are responsible for all activity on your account.

- Users are responsible for maintaining the confidentiality of their login credentials. If an account is compromised due to user negligence, House of Avatars is not liable for any resulting consequences.

3. Community Guidelines & Chat Rules

House of Avatars is designed to be a safe and friendly space for everyone. So, let's keep things civil and enjoy the environment! Even Groundskeeper Lurch—who has seen many strange things in the graveyard—expects a certain level of decorum. Our core rules:

Be Respectful & Courteous:

- No abusive, hateful, or discriminatory language.

- No harassment, bullying, or threats (Groundskeeper Lurch has enough to deal with already).

- No spamming, trolling, or chat disruptions. Seeker Lilith prefers deep discussions, not chaos.

Be Honest & Authentic:

- No impersonation of users, moderators, or entities (yes, even the NPCs).

- No sharing of personal or sensitive information—Lilith reminds you that mystery is best when it comes to sensitive information.

- No soliciting, promoting, or advertising products, services, or causes.

- No violations of laws or regulations—Lurch doesn’t want to add another name to the graveyard.

Be Mindful & Responsible:

- No illegal, harmful, or offensive content.

- No content that infringes on the rights of others.

- No outside web content that violates these guidelines.

- No irrelevant or inappropriate content for the app.

- The app does not allow clickable links or copying text in-app, so attempts to share unauthorized content via chat are discouraged.

- No attempts to hack, exploit, or disrupt the App's services

Hosts (moderators) reserve the right to mute, kick, or ban users at their discretion. You may appeal decisions via contact@houseofavatars.com or the contact form.

Failure to follow these rules may result in account suspension, chat restrictions, or permanent bans.

4. Moderation, Mute, Kick & Ban Policy

House of Avatars has moderation tools in place, and moderators may take action against users who violate these ToS. We get it—sometimes things get heated, and sometimes people just love pressing buttons. However, to maintain a chill and welcoming environment, we have moderation in place. Moderators may:

- Mute – Temporarily restrict chat access for users who need a timeout (Groundskeeper Lurch thinks of it as a short nap).

- Kick –  Remove a user from the App temporarily (Seeker Lilith might suggest reflecting in silence).

- Ban – Permanently disable an account (a fate worse than wandering the graveyard alone).

Users have 14 days to appeal any moderation action. After an appeal is reviewed, the decision is final. Repeated appeals for the same action will not be considered. Banned users will not receive refunds (if applicable). If you believe you were falsely moderated, you may submit an appeal via contact@houseofavatars.com or the contact form.

5. Account Termination & Deletion

- Users may delete their accounts via the App’s settings or request deletion via contact@houseofavatars.com or the contact form.

- Once an account is deleted, associated data is removed within 60 days, except where retention is required by law.

- We reserve the right to suspend or terminate accounts at our discretion, especially for violations of these Terms.

6. Privacy & Data Usage

- By using the App, you acknowledge that we collect and process personal data such as your email for registration and account management.

- Chat messages may be monitored, logged, or deleted to ensure compliance with these ToS. The storage and retention of chat logs are managed by Unity or Proton Engine, and House of Avatars does not provide an option for users to request chat log deletion.

- Your privacy is governed by our Privacy Policy.

7. Liability Disclaimer

- House of Avatars is provided "as is" without warranties of any kind.

- We are not responsible for any user-generated content or interactions within the App.

- We do not guarantee uptime or uninterrupted service and may modify or discontinue the App at any time.

- We are not liable for any damages, losses, or disputes arising from the use of the App.

8. Intellectual Property

- House of Avatars and all associated branding, assets, and content remain the intellectual property of Jameweb.

- Users retain rights to their chat messages but grant House of Avatars permission to moderate and remove content as necessary.

9. Third-Party Services

- House of Avatars is built using Unity Technologies, which may collect and process certain device data, analytics, and IP addresses for performance monitoring and security.

- We do not control Unity’s data collection, and its policies govern any data it processes.

- You can review Unity’s Privacy Policy here: Unity Privacy Policy.

- By using House of Avatars, you acknowledge and accept Unity’s data practices as part of the app’s functionality.

- We are not responsible for third-party links, services, or content shared by users.
